IRS Tax Relief Forms

As you can imagine, the IRS has an entire set of forms it sends out for various reasons. Luckily, each form comes with instructions for use.

Let’s look at some common IRS notices. 

Offer in Compromise Forms

IRS Form 656: IRS Offer in Compromise form

Income Certification for Offer in Compromise: this is an application for a waiver of the application fee. 

IRS Form 656-A: (Application Fee and Payment); each form requires a $205 application fee and initial payment, except for individuals that qualify for low-income certification. 

Collection Information Statement for Wage Earners and Self-Employed: used to fill in financial information related to your offer in compromise. This is for wage earners and self-employed individuals. 

IRS Form 433-A (OIC) collects detailed information about your finances. The IRS uses this information to determine your eligibility for an offer in compromise. 

IRS Form 433-B (OIC): (Collection Information Statement for Businesses): collects information to support an Offer in Compromise for businesses like partnerships, corporations, and limited liability companies. 

IRS Installment Agreement Forms

IRS Form 9465: IRS Installment Agreement Request Form: used to request an installment plan if you can’t pay the total amount of tax owed or the amount noted in a notice from the IRS. 

IRS Form 433-F: IRS Collection Information Statement: used to obtain financial information to help determine whether you can pay your liability in full or via an installment plan. 

IRS Form-433-D: IRS Installment Agreement Form: you get this form after the IRS approves an installment agreement. It outlines the amounts to be paid monthly, and once you sign it, it becomes binding. 

Innocent Spousal Relief Forms

IRS Form 8857; Request for IRS Innocent spouse Relief: you can fill in these forms to request relief from a tax liability and its accompanying penalties and interest.

Taxpayers fill this in when they feel that only their spouse or ex-spouse should be fully or partially responsible for the tax liability. 

IRS Penalty Abatement Forms

IRS Form 843: Claim For Refund and Request for Abatement: this form is used to request a refund of some assessed taxes or to request abatement of penalties and interest applied erroneously by the IRS. 

IRS Prove Financial Hardship or Be Considered Uncollectible

IRS Form 433-A: Collection Information Statement For Wage Earners and Self-Employed Individuals: this form collects financial information to help determine how a taxpayer can settle an outstanding tax liability. 

Fill out this form if:

  • You owe income tax on form 1040
  • You are an individual partly responsible for a partnership liability
  • You are the individual owner of a limited liability company that is a disregarded entity
  • You are an individual who is self-employed or with a self-employed income 

IRS Form 433-F: IRS Collection Information Statement: this form is filled out by taxpayers with outstanding liability. It generally seeks financial information so the IRS can assess your eligibility for different payment plans. 

IRS Tax Lien Forms

IRS Form 12277: IRS Application for Withdrawal of a Federal Tax Lien: the primary function of Form 12277 is to apply for the withdrawal of a notice of federal tax lien. Note that the IRS might consider other aspects of your credit history besides filling in form 12277. This means you might need to take other actions to help with the withdrawal process. 

A withdrawal removes your tax lien from your credit report entirely, which can help improve your credit rating. 

IRS Form 14135 IRS Application for Certificate of Discharge of Property from Federal Tax Lien: a certificate of discharge of property from a federal tax lien is simply a document that informs the court of the IRS’s intent to release your property from a lien. 

IRS Substitute W-2 Form to File Back Taxes Forms: 

These can be:

  • Substitute W-2 Wage and Tax Statement
  • Form 1099-R 
  • Form 4852 

IRS Tax Appeals

IRS Form 12153 IRS Collection Due Process Hearing: if the IRS sends you a notice of its intent to place a levy or tax lien on your assets, you can request a due process (CDP) hearing. To do so, you fill in form 12153 to ask for a hearing to appeal the lien or levy.

IRS Form 9423 IRS Collections Appeals Program: this form is used to request an appeal against a notice of federal tax lien, seizure, levy, or termination of a payment plan. 

Form 1040X Amending a Tax Return Form: You can file Form 1040X to:

  • Make changes on Form 1040, 1040-SR and 1040-NR
  • Make particular elections past the deadline
  • Change amounts previously adjusted by the IRS
  • Request a carryback due to loss or unused credit

IRS Form 4868 IRS Tax Filing Extension: taxpayers can use this form to apply for an automatic extension of time to file their tax returns. Note that this does not grant an extension to pay your taxes. This means you can get an extension for filing, but you will still be penalized for late tax payments. 

IRS Power of Attorney

IRS Form 2848 Power of Attorney and Declaration of Representatives: for privacy reasons, the IRS will not discuss your tax matters with just anyone.

For you to appoint an individual to represent your interests, fill out and submit Form 2848 to authorize an individual to represent you. The chosen person must be eligible to practice before the IRS.
